The OSHA
Construction Industry and General Industry Standards (29 CFR
1926.1101 and 29 CFR 1910.1001, respectively) of 1995 present
stringent requirements for all employers to prevent employee
exposure to asbestos fibers in the workplace. These regulations
cover all employees, including subcontractor and tenant
employees, and make facility owners, operators, and managers
culpable for failure to comply.
 
State regulations typically enforce the EPA National Emission
Standard for Hazardous Air Pollutants (NESHAP, 40 CFR 61,
Subpart M) requirements and training requirements for persons
who handle or disturb asbestos containing materials (ACMs) or
presumed asbestos containing materials (PACMs).
Asbestos liability can include significant fines and/or
imprisonment for violation of the statutes, and tort liability
associated with employee exposures.
