What Does the
NPDES General Permit Require?
The EPA issued its final NPDES general permit for stormwater
discharge from industrial activities on September 22, 2008. The
permit requires facilities located in Alaska, Idaho,
Massachusetts, New Hampshire, New Mexico, the District of
Columbia, and in U.S. territories where EPA remains the
permitting authority to file a Notice of Intent with the EPA.
File NOI:
-
No later than
January 5, 2009 for existing discharges in operation as of
10/30/05
-
As soon as
possible but no later than January 5, 2009 for new
discharges commenced between October 30, 2005 and January 5,
2009
-
A minimum of
60 days prior to commencement of discharge or a minimum of
30 days if SWPPP is posted on EPA website
Complete or
Revise Stormwater Pollution Prevention Plan (SWPPP)
Your SWPPP must be prepared prior to submitting your Notice of
Intent (NOI) for permit coverage. If you prepared a SWPPP for
coverage under a previous NPDES permit, you must review and
update the SWPPP to implement all provisions of this permit
prior to submitting your NOI.
What was Revised Under the New SWPPP Permit?
Under the new
SWPPP permit, the EPA has revised:

Information required for NOI to allow the EPA to
determine eligibility, water quality based
requirements, etc.;

Permit approach to water quality based effluent
limits to better ensure discharges are controlled as
necessary to meet water quality standards;

Data;
-
Eligibility provision for Protection of Endangered
Species and Historic Spaces were modified;
-
Clarifies corrective actions requirements;
-
Changes in monitoring provisions;
-
Permittees are required to submit an Annual report
that includes findings from Annual Comprehensive
Site Inspection Report and any findings that trigger
Corrective Action; and
-
Changes to industry-specific requirements.
