The NYSDEC recently revised dam safety regulations in an effort to protect the public as well as clearly define dam owner responsibilities. The revised dam safety regulations apply to dams that are 15 feet or higher or have a capacity of greater than three million gallons.

 

The revised dam regulations require dam owners to complete the following:

  • Inspection & Maintenance Plan – Establish procedures to ensure dam safety and fitness. Must be completed by August 19, 2010.

  • Emergency Action Plan (Intermediate and High) – Comprehensive summary of procedures to undertake in the event of a potential life threatening event at or near the dam (i.e. dam breach, flooding, unnatural disaster). Must be completed by August 19, 2010 for High Hazard Dams and August 19, 2011 for Intermediate Hazard Dams.

  • Annual Certifications (Intermediate and High) – A mandatory filing to DEC verifying information pertaining to the dam.

  • Safety Inspections (Intermediate and High) – Completed by an engineer to assess the fitness of the dam.
